A number of questions have been raised over the particulars surrounding the differences in restrictions and their enforcement. South Tyneside Council enforce the Traffic Management Act 2004. As such, observation periods (a period of time that must pass before a Notice can be issued/served) is required in most cases.
In Nicholas Avenue, the major restriction is the Permit Holder only restriction. Any vehicle found to park in this area without a valid permit, must be observed for at least 5 minutes. This period of time allows the driver to obtain a valid permit or pick up or drop off passengers.
Furthermore, school keep clears are in place and they are severe restrictions. Any vehicle found to stop on the keep clear markings during restricted hours can be issued an instant Notice. This must be witnessed by a Civil Enforcement Officer.
With regard to double yellow lines, drivers can park with a blue badge (for three hours) – providing they do not cause obstruction, drop off or pick up passengers or load and unload. A 5-minute observation period is also required where yellow lines are in position.
